AUZ BATTERIES -TERMS AND CONDITIONS
Last Updated: [20/8/2026] These Terms & Conditions apply to all purchases of products and services from AuzBatteries (“AuzBatteries”, “we”, “us” or “our”), including purchases made through our website, by telephone, email, social media, in person or through any other sales channel. By placing an order with AuzBatteries, you agree to these Terms & Conditions. Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law (“ACL”) or any other applicable law.
1. Definitions Customer means the person or business purchasing products or services from AuzBatteries. Product means any battery, accessory, charger, component or other product supplied by AuzBatteries. Vehicle includes cars, trucks, motorcycles, boats, caravans, machinery, equipment and any other vehicle or application in which a Product is used. Warranty Claim means a claim that a Product has a manufacturing defect or other fault covered by the applicable manufacturer’s warranty or consumer guarantees under the ACL. 2. Product Information AuzBatteries takes reasonable care to ensure that product descriptions, specifications, images, dimensions, capacities, CCA ratings and other information displayed on our website or provided to customers are accurate. However, specifications may change from time to time due to manufacturer updates. Images are for illustration purposes only and may not always represent the exact appearance of the Product supplied. The Customer is responsible for ensuring that the Product selected is suitable for the intended application unless AuzBatteries has specifically confirmed suitability based on information supplied by the Customer.
3. Battery Selection Battery selection is an important part of purchasing a battery. Where the Customer selects a battery themselves, the Customer is responsible for ensuring that the battery is suitable for the Vehicle and intended application. This includes, where applicable: battery dimensions; terminal position and configuration; polarity; terminal type; voltage; Ah capacity; CCA requirements; battery technology; charging requirements; vehicle compatibility; start-stop requirements; auxiliary battery requirements; manufacturer’s requirements; and any other application-specific requirements. Where AuzBatteries recommends or confirms a battery based on information provided by the Customer, the Customer remains responsible for ensuring that the information supplied to AuzBatteries is accurate and complete. AuzBatteries is not responsible for a Product being unsuitable where incorrect, incomplete or misleading vehicle or application information was provided by the Customer. Nothing in this clause limits any rights the Customer may have under the ACL.
4. Installation Unless expressly agreed otherwise in writing, AuzBatteries does not provide installation services. The Customer is responsible for ensuring that Products are installed correctly and, where appropriate, by a suitably qualified person. Incorrect installation may cause damage to the battery, vehicle, electrical system or other components. AuzBatteries is not responsible for damage, loss or failure caused by incorrect installation, incorrect connection, reversed polarity, incorrect wiring, unsuitable equipment or failure to follow manufacturer instructions, except to the extent liability cannot lawfully be excluded.
5. Vehicle Electrical System and Charging System A battery is part of a vehicle’s electrical system and its performance may be affected by other components. AuzBatteries is not responsible for battery failure caused by, or contributed to by: alternator faults; charging-system faults; overcharging; undercharging; voltage-regulator faults; parasitic electrical drain; excessive standby current; electrical accessories; faulty wiring; vehicle electrical faults; starter motor faults; aftermarket accessories;
solar or auxiliary charging systems; battery management system faults; or any other fault or condition within the Vehicle.
Where a battery repeatedly becomes flat, the Customer should have the Vehicle’s charging and electrical systems professionally inspected. A battery that has become discharged does not necessarily have a manufacturing defect.
6. Battery Charging and Maintenance The Customer is responsible for maintaining the Product in accordance with the manufacturer’s instructions. Lead-acid, AGM, lithium and other battery technologies may have different charging and maintenance requirements. A battery should not be left in a substantially discharged state for extended periods. Failure to maintain or correctly charge a battery may cause permanent damage and may affect warranty eligibility where the failure resulted from that condition. Where appropriate, AuzBatteries may require evidence of charging voltage, resting voltage, load testing or other diagnostic information before determining whether a Product is defective.
7. Use and Care of Products Products must be used only for their intended purpose and in accordance with applicable manufacturer instructions. A warranty claim may be rejected where examination reasonably establishes that the failure was caused by: misuse; abuse; neglect; accidental damage; physical damage; incorrect installation; incorrect charging; deep discharge; over-discharge; overcharging; unsuitable application; modification; tampering; unauthorised repair; incorrect storage; exposure to conditions outside the manufacturer’s specifications; or another cause unrelated to a manufacturing defect. This does not affect any rights or remedies that cannot legally be excluded under the ACL.
8. Orders An order is not accepted until AuzBatteries confirms the order or dispatches the Product. AuzBatteries may refuse or cancel an order where reasonably necessary, including where: the Product is unavailable; an obvious pricing or listing error has occurred; payment has not been successfully received; the delivery address cannot reasonably be serviced; the order appears fraudulent or unauthorised; the Product has been incorrectly listed or described; circumstances outside AuzBatteries’ reasonable control prevent fulfilment; or fulfilling the order would otherwise be unlawful or unreasonable. If an order is cancelled after payment has been received, AuzBatteries will provide an appropriate refund in accordance with applicable law.
9. Pricing All prices are displayed in Australian dollars unless stated otherwise. Prices may change without notice, but the price applicable to an accepted order will generally be the price displayed or otherwise quoted at the time the order was placed. Where an obvious pricing error occurs, AuzBatteries may cancel the affected order and refund any payment received.
10. Payment Payment must be received in accordance with the payment terms applicable to the order. AuzBatteries may delay dispatch until payment has been successfully received. For approved account customers, payment must be made in accordance with the agreed account terms. AuzBatteries may suspend or refuse further supply where an account is overdue.
11. Delivery AuzBatteries will make reasonable efforts to dispatch Products within the estimated timeframe provided at the time of purchase. Delivery times are estimates only and may be affected by couriers, transport providers, weather, road conditions, public holidays, supply issues or other circumstances outside AuzBatteries’ reasonable control. AuzBatteries is not responsible for delays caused by third-party delivery providers or circumstances outside our reasonable control. The Customer must provide an accurate delivery address and any relevant delivery instructions. Additional delivery charges may apply where an incorrect address, failed delivery or redelivery is caused by information supplied by the Customer.
12. Delivery Inspection Customers should inspect Products as soon as reasonably practicable after delivery.
If a Product appears physically damaged on arrival, the Customer should notify AuzBatteries as soon as possible and provide photographs and relevant delivery information. Any damage should be documented before the Product is installed or used where reasonably possible. Nothing in this clause limits any rights the Customer may have under the ACL.
13. Returns and Change of Mind Unless otherwise stated, AuzBatteries is not required to provide a refund or exchange simply because a Customer has changed their mind, selected the wrong Product or no longer requires the Product, except where required by law or where AuzBatteries has expressly offered a change-of-mind return policy. Any approved change-of-mind return may be subject to reasonable conditions, including that the Product is unused, undamaged and in suitable condition for resale. Where a Product has been installed, used, charged, modified or damaged, AuzBatteries may assess whether a return is available under the applicable return policy and law. These provisions do not limit the Customer’s rights where a Product fails to comply with the consumer guarantees under the ACL.
14. Australian Consumer Law AuzBatteries acknowledges that Australian Consumer Law provides consumers with certain mandatory rights and guarantees. Where the ACL applies, Products supplied by AuzBatteries must comply with the applicable consumer guarantees, including guarantees relating to acceptable quality, fitness for purpose, correspondence with description and other applicable requirements. Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot legally be excluded under the ACL. Where a Product has a major failure, the Customer may have rights to a refund, replacement or other remedy as provided by law. Where a Product has a minor failure, AuzBatteries may be entitled to provide a repair or other appropriate remedy as permitted by law.
15. Manufacturer Warranty Where a Product is supplied with a manufacturer’s warranty, that warranty applies in addition to any rights the Customer has under the ACL. A manufacturer’s warranty does not replace or limit the Customer’s non-excludable rights under Australian law. Warranty periods commence from the date of purchase unless otherwise stated by the manufacturer. Warranty claims may require: proof of purchase; battery serial number; vehicle details; details of the battery’s application; evidence of charging voltage; battery test results; photographs; inspection of the Product; and/or other reasonably necessary information.
16. Warranty Assessment AuzBatteries may require the Product to be returned or made available for inspection and testing before a warranty claim is approved. A warranty assessment may include testing the battery’s: voltage; conductance; capacity; internal resistance; state of charge; charging history where available; and physical condition. A battery that is flat or discharged may need to be recharged before a complete assessment can be performed. A flat battery is not automatically considered faulty. If testing establishes that the Product is operating normally and no defect covered by the applicable warranty or ACL is identified, the warranty claim may be declined, subject to the Customer’s legal rights.
17. Warranty Exclusions To the extent permitted by law, warranty coverage does not extend to failures caused by conditions unrelated to a manufacturing defect, including: incorrect battery selection; incorrect installation; reversed polarity; incorrect wiring; incorrect charging; overcharging; undercharging; prolonged discharge; deep cycling where the Product is not designed for that application; parasitic drain; faulty alternator or charging system; vehicle electrical faults; excessive accessory load; physical damage; accident; impact; leakage caused by damage or misuse; modification; tampering; unauthorised repair; incorrect storage; use outside the Product’s intended application; failure to follow manufacturer instructions; or
normal wear and deterioration associated with use. The exclusion of a warranty claim does not exclude any mandatory rights or remedies available under the ACL.
18. Labour, Installation and Related Costs Unless expressly agreed otherwise in writing, AuzBatteries’ warranty obligations do not include the cost of: installation; removal; reinstallation; vehicle recovery; towing; mechanic or electrician fees; diagnostic fees; travel expenses; call-out fees; loss of use; loss of income; business interruption; or other third-party costs, except to the extent that such costs are recoverable under a non-excludable right or remedy under applicable law.
19. Replacement Products Where AuzBatteries or the manufacturer approves a warranty replacement, the replacement Product will generally be of the same or equivalent specification, subject to availability and applicable law. A replacement Product does not necessarily restart or extend the original warranty period unless required by the applicable warranty or law.
20. Refunds Where a refund is required under the ACL or an applicable warranty, AuzBatteries will process the refund using the original payment method where reasonably practicable. Where a refund is not legally required, AuzBatteries may determine whether a refund, exchange, credit or other remedy is available under its applicable return policy.
21. Limitation of Liability To the maximum extent permitted by law, AuzBatteries will not be liable for loss or damage caused by matters outside AuzBatteries’ reasonable control or by the Customer’s misuse, incorrect selection, incorrect installation, modification, neglect or failure to maintain the Product. To the maximum extent permitted by law, AuzBatteries is not responsible for indirect, incidental or consequential loss arising from the use, installation, failure or unavailability of a Product where such loss is not caused by a failure by AuzBatteries to comply with a non-excludable legal obligation. Nothing in these Terms & Conditions excludes liability for conduct or circumstances where such exclusion is prohibited by law.
22. Customer Responsibility for Vehicle Suitability The Customer acknowledges that battery performance depends on the Vehicle and its electrical system. AuzBatteries does not guarantee that replacing a battery will resolve a vehicle starting problem where another component or system is faulty. Where a Customer experiences repeated battery discharge, starting problems or abnormal battery behaviour, the Customer should have the Vehicle professionally diagnosed.
23. Indemnity To the maximum extent permitted by law, the Customer is responsible for losses, costs or damage caused by the Customer’s unlawful use of a Product, intentional misuse, unauthorised modification or other conduct that is outside the proper use of the Product. Nothing in this clause requires the Customer to indemnify AuzBatteries for loss caused by AuzBatteries’ own breach of a non-excludable obligation or other liability that cannot legally be transferred to the Customer.
24. Product Safety Customers must use Products safely and in accordance with applicable manufacturer instructions. Batteries can contain hazardous substances and can produce dangerous electrical currents and gases. Customers must follow all relevant safety instructions when handling, charging, transporting, installing and storing batteries. Customers should not attempt to open, modify, repair or dismantle batteries unless specifically authorised and suitably qualified to do so.
25. Trade and Business Customers Where the Customer purchases Products primarily for business or commercial purposes, different provisions of the ACL may apply depending on the circumstances of the transaction. Nothing in these Terms & Conditions is intended to unlawfully exclude rights available to a business customer under applicable law. AuzBatteries may require approved business customers to agree to separate account, credit or trade terms.
26. Privacy
Customer information will be handled in accordance with AuzBatteries’ Privacy Policy. Information may be collected and used to: process orders; arrange delivery; process payments; provide customer support; manage returns and warranty claims; communicate with customers; prevent fraud; maintain business records; and comply with legal obligations.
27. Force Majeure AuzBatteries will not be responsible for delays or failure to perform an obligation where the delay or failure is caused by circumstances outside our reasonable control. This may include natural disasters, severe weather, fire, flood, transport disruption, supplier disruption, shortages, industrial action, government action, war, civil unrest, telecommunications failures, cyber incidents or other circumstances beyond our reasonable control. Where reasonably possible, AuzBatteries will take reasonable steps to minimise the effect of such circumstances.
28. Changes to These Terms AuzBatteries may update these Terms & Conditions from time to time. The Terms & Conditions applicable to an order will generally be those in effect when the order is placed, subject to any rights that apply under Australian law.
29. Severability If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.
30. Governing Law These Terms & Conditions are governed by the laws applicable in New South Wales and the Commonwealth of Australia. Nothing in this clause prevents a Customer from exercising rights or remedies available under applicable Australian consumer protection laws.
